  • One key characteristic of the TFWP is the requirement for a Labour Market Impact Assessment (LMIA). Any employer wishing to hire a foreign national as a Temporary Foreign Worker must first obtain a positive LMIA. This application is a technical and time-bound application and has to be done very carefully. Only after obtaining a positive LMIA will an employer be able to officially hire a foreign national, enabling the foreign national, in turn, to apply for a Canadian work permit or Canadian permanent residence.   • The International Mobility Program (IMP) enables Canadian employers to hire temporary foreign workers without the need for a Labour Market Impact Assessment (LMIA). While most employers hiring foreign workers will require an LMIA, there are certain circumstances where LMIA-exemptions exist. These LMIA exemptions are based on one of the following conditions:

    - Broader economic, cultural, social, or other competitive significant benefits for Canada

    - Reciprocal employment benefits enjoyed by Canadians abroad

    - Religious and Charitable Workers

    Intra Company Transfers (ICT)

    Canada’s International Mobility Program outlines provisions to enable high-skilled foreign nationals to work temporarily in Canada as intra-company transferees. Through this provision, certain companies may transfer a foreign national to a Canadian location in order to improve the quality of their business for the benefit of Canadians. If a foreign national is an employee of a multinational company in a location outside of Canada, they may be eligible to obtain an LMIA -exempt work permit to transfer to one of the company’s locations within Canada. The intra-company transferee rule applies to all countries.

    Entrepreneurs/Self-Employed Persons

    An LMIA exemption may be granted to private entrepreneurs who wish to come to Canada temporarily in order to start or operate a business. Applicants to one of these programs must be the sole or majority owners of the business they wish to pursue in Canada. They will also have to demonstrate that their business will be of significant benefit to Canada.

    International Agreements

    A significant number of LMIA-exemptions are available through international agreements between Canada and other countries. Certain types of employees can transfer to Canada from other countries, and vice versa, if they are able to demonstrate this will have a positive impact. Canada has negotiated the following Free Trade Agreements, each encompassing a range of LMIA-exemptions:

    - North American Free Trade Agreement (NAFTA)

    - Canada-Chile FTA / Canada-Peru FTA / Canada-Colombia FTA / Canada-Korea FTA

    Religious and Charitable Worker

    The Religious or Charitable Work visa program entitles foreign workers to enter Canada on a temporary basis to carry out duties for religious or charitable organizations. Applicants who want to perform or serve a Canadian religious or charitable institution may apply for this type of visa.

    However, it is essential that religious workers should possess the required credentials, documentation, experience, and skills for the position they propose to hold. This visa allows the applicants to live and work in Canada on a temporary basis. In addition, this visa may prove to be beneficial for the applicant and help them acquire eligibility for permanent residence in Canada.

    Another popular category of LMIA-exemptions fall under the broad category of Canadian Interest exemptions.     In order to qualify for an LMIA-exemption under the category of significant benefit for Canadians, the employment of a foreign national must demonstrate significant social or cultural benefit to Canada. Under the Global Skills Strategy, certain foreign nationals are eligible to apply to have their work permits processed in two weeks, if they are applying from outside of Canada meeting either of the two conditions:

  • International Experience Canada (IEC) is a set of programs enabling young people from participating countries to travel to Canada to live and work temporarily. Foreign nationals who meet the criteria of one of the IEC programs are eligible to apply for a Canadian Work Permit with the need for a Labour Market Impact Assessment (LMIA). To participate in International Experience Canada a foreign national must be within the accepted age range for their country’s program (maximum age of 35 years old) and their country of citizenship must have an agreement with Canada, allowing the foreign national to apply for a work permit under one of the following categories: Working Holiday, Young Professionals, International Co-op Internship. Member countries may not participate in all three types of programs.
